Unless otherwise required by applicable law, we have the right to terminate this agreement and/or access to the TestSmarter.net site or any associated software and/or service at any time, at our discretion should it be suspected of misuse or infringement upon patient rights including all HIPPA regulations. In no event will TestSmarter Inc. be liable for any direct or indirect, special, incidental, consequential, or punitive damages or lost profits arising in connection with use of our software and services, any interruption in availability of our website, delay in operation or transmission, computer virus, loss of data, or otherwise.

Medical Devices issued by TestSmarter Inc. are proprietary to TestSmarter Inc. and not to be used, tampered with, or altered without exception. The medical devices are to be used exclusively with the TestSmarter.net website without exception. The testing data contained in the medical device is transmitted only through TestSmarter.net and unable to be altered by any party. Device data is formulated into a PDF report and is not to be altered by any party. Attempts to alter data will be a direct breach of these terms and conditions.
